On Tuesday September 1, 2020 at 6:30pm via video conference, the Corte Madera Town Council will hold a Public Hearing to review information, receive public comments, and consider introduction of a proposed Municipal Code Amendment prepared by the Town of Corte Madera.
The proposed Ordinance would amend Section 18.02.090 of the Town of Corte Madera Zoning Ordinance to: 1) Make the Town’s Zoning Ordinance inapplicable to Town-owned property; and 2) add a new planning or land use review procedure for proposed projects on Town-owned property.
The proposed ordinance is necessary in order to enable the Town Council to assert appropriate control over Town resources, balance policy interests and to allow the Town of Corte Madera Town Council to make final determinations on matters related to land use, zoning compliance, environmental review, and design. Currently, pursuant to the Town’s Zoning Ordinance (Title 18 of the Town’s Municipal Code), the Town’s Planning Commission is the decision-making body on such matters unless a project is appealed to the Town Council.
The proposed Ordinance would require that projects on Town-owned property be reviewed by the Planning Department (minor reviews) or the Planning Commission (major reviews), who would make recommendations via report to the Town Council for consideration. The Town Council would make final determinations. The same public noticing and outreach process (including public meetings) that is currently utilized by Town staff and the Planning Commission would be required.
The Planning Department recommends that the proposed municipal code amendments are not subject to the provisions of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061 because the proposed Municipal Code amendments only modify the administrative process by which Town projects are reviewed and therefore, it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment.

- Staff reports are usually available by 5:00 p.m. on the Friday before the meeting and may be obtained from the project contact (listed above).
- If you challenge this project in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this NOTICE, or in written correspondence delivered to the Town of Corte Madera at, or prior to, the public hearing. All written responses will become part of the public record (Government Code Section 65009(b)).
