On Tuesday, October 1, 2019, the Corte Madera Town Council will hold a Public Hearing to consider introducing an Ordinance repealing and replacing Municipal Code Chapter 9.36 (Noise) to update and clarify the regulation of excessive and offensive noise

NOTICE IS HEREBY GIVEN that the Corte Madera Town Council will hold a public hearing to consider introduction of an Ordinance that would repeal and replace Chapter 9.36 (Noise) of the Municipal Code to update and clarify the regulation of excessive and offensive noise. The purpose of the Ordinance is to update, modernize and clarify the existing noise ordinance to implement the General Plan and to alleviate challenges currently faced by the Town in the implementation and enforcement of its existing noise ordinance regulations of community noise arising from diverse sources such as transportation, construction, mechanical equipment, entertainment, and human behavior.  


Among other updates, the proposed Ordinance:  Updates the noise level measurement provisions; modernizes the maximum noise levels for mechanical devices based on zoning district, establishes updated restrictions on the use of leaf blowers, exempts from the noise regulations use of emergency equipment (including generators used during power outages), revises the times of day and methodology for regulating noise from nonmechanical sources, revises the penalties and remedies for violation of the Ordinance, and establishes how repeat noise complaints are to be addressed. 


If introduced by the Town Council on October 1, 2019, the proposed ordinance may be considered for adoption at a subsequent Town Council meeting as soon as October 15, 2019, and would become effective 30 days following the date of its adoption.


All persons interested in the foregoing are invited to appear before the Corte Madera Town Council at the time, day and place mentioned above. A staff report related to this item will be available on or before 5:00 p.m. on Friday, September 27, 2019, and may be obtained from the Town Clerk, Corte Madera Town Hall, 300 Tamalpais Drive, Corte Madera or via the Town’s website.
