[ARCHIVED] Public Hearing Notice - Considering Extension of Tamal Vista Moratorium

At the Town Council Meeting on 9/04/15, the Council will consider extending the moratorium on issuance of any planning-related permits for properties located between Tamal Vista Blvd., Highway 101, Madera Blvd., and Wornum Drive.

Subject: Consideration of extending the moratorium on issuance of any planning-related permits for properties located between Tamal Vista Blvd., Highway 101, Madera Blvd., and Wornum Drive.

On October 7, 2014, the Town Council of Corte Madera adopted Ordinance No. 942, establishing an urgency 45-day interim ordinance prohibiting, the issuance of any planning-related permits, including design review, variance, preliminary or precise plans, use permits, general plan or zoning ordinance amendments, and subdivision approvals for properties located between Tamal Vista Blvd., Highway 101, Madera Blvd., and Wornum Drive. On November 18, 2014, the Town Council extended the ordinance until October 7, 2015, by adopting Ordinance No. 943. The Town Council will now consider extending the moratorium for up to an additional 365 days, until October 7, 2016, pursuant to California Government Code Section 65858(a).

The Planning Department recommends that the extension of the ordinance would be exempt from California Environmental Quality Act (CEQA) under: (a) Section 15308 of the State CEQA Guidelines because it is a regulatory action taken by the City in accordance with California Government Code Section 65858 to assure maintenance and protection of the environment; (b) Section 15060(c)(2) because it will not result in a direct or reasonably foreseeable indirect physical change in the environment; and (c) section 15060 (c)(3) because it is not a project within the meaning of CEQA since it has no potential for resulting in physical changes in the environment.

All persons interested in the foregoing are invited to appear before the Corte Madera Town Council at the time, day and place mentioned above. If you challenge this project in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this NOTICE, or in written correspondence delivered to the Town of Corte Madera at, or prior to, the public hearing. All written responses will become part of the public record.
